1. Purpose
In these documents, "Beat Works," "we," "us," and "our" refer to the website design, development, e-commerce, maintenance, digital and related service provider identified on the applicable proposal, invoice or order form. "Client," "you," and "your" refer to the person or organization purchasing or using the Services. "Services" means only the work expressly identified in an accepted proposal, statement of work, order form or invoice.
This Website Maintenance Agreement applies when a Client purchases recurring or fixed-term maintenance from Beat Works.

2. Included Maintenance
Only tasks listed in the maintenance plan are included. Typical services may include routine content edits, software/plugin updates, backups, security checks, uptime review or minor troubleshooting, but only where expressly stated.

3. Excluded Work
Redesigns, new pages, new features, major code changes, copywriting, product catalog entry, emergency recovery, malware remediation, accessibility audits, SEO campaigns, advertising, hosting migration and third-party subscription fees are excluded unless listed.

4. Requests and Hours
Requests must be submitted through the agreed communication channel. Included hours do not roll over unless the plan expressly says they do. Work beyond the plan requires Client approval and may be billed separately.

5. Access and Backups
The Client must maintain or provide required administrative access. Beat Works may make reasonable backups when included, but no backup system is infallible. The Client should maintain independent copies of critical business data.

6. Third-Party Updates
Software and platform updates can cause incompatibilities. Beat Works will use reasonable care but cannot guarantee that third-party updates will not break features or require separately billable remediation.

7. Security
Maintenance reduces risk but does not guarantee that a website will never be hacked, infected, interrupted or lose data. The Client remains responsible for secure credentials, authorized users and business continuity.

8. Fees and Renewal
Fees, billing frequency, initial term and renewal terms are stated in the order. Any automatic renewal must be disclosed and implemented in accordance with applicable law. Overdue undisputed fees may result in suspension after appropriate notice.

9. Cancellation
Either party may cancel according to the plan's stated notice period, subject to mandatory law and any agreed minimum term. Fees earned for Services already supplied and approved third-party costs remain payable.

10. Liability
Liability is limited as provided in the applicable Beat Works agreement and only to the extent permitted by law.
